Le Gouvernenient Italien a donné déjà des instructions à son Consul. Toutefois, comme il est à prévoir qu'on arrivera difficilement à une entente à Shanghaï avec le Taotai, je demande à mes collègues si, afin de nc pas laisser traîner cet incident, on ne pourrait pas profiter de ce que le Wai-wu Pu s'est adressé à quelques-uns d'entre nous, pour leur confier le soin, s'ils voudront bien s'en charger, de parvenir avec le Gouvernement Central à une solution qui réunirait les suffrages de toutes les Légations.

Je suis de l'avis de son Excellence le Ministre d'Italie, que la meilleure manière d'arriver à une solution de la question serait d'entrer cu négociations diverses avec le Wai-wu Pu.

Peut-être pourrait-on lui suggérer une démarche auprès du Corps Diplomatique afin que celui-ci soit mis à même de discuter avec lui l'affaire.

Il faut cependant constater que jusqu'à présent le Gouvernement Central ne s'est pas encore officiellement adressé au Corps Diplomatique.

Sir,

August 30, 1903. IN the matter of the criminals Chang, Tsou, and the other men who were seized at Shanghae, I have frequently instructed the Taotai to consult with you for the handing over of these men, and further have at different times communicated with the several Consuls asking for the immediate return of these men.

On looking into the British Treaty, section 21, one finds: "if Chinese offenders take refuge in the houses or on board the vessels of British subjects at the open ports, they shall not be harboured or concealed, but shall be delivered up on due requisition by the Chinese authorities addressed to the British Consul."

The Treaties with America, France, Germany, Russia, Japan, Italy, Belgium, Spain, Holland, Denmark, Austria, are all very similar.

Inasmuch as these criminals are Chinese, the place where the offence was com- mitted is a part of the Empire of China, and it is a duty to hand offenders back to the Chinese authorities for trial and punishment. all of these represent the sovereign rights of China, which no country should in any way infringe or violate.

It is for this reason that it is inserted in the Treaties with all Powers that offenders shall not be barboured or concealed, but shall be immediately delivered up; and this would be acting according to justice.

If, when the Shanghae Taotai first discussed the matter, he did say that the prisoners should be tried in the Mixed Court, and therefore you wish to consider this as a positive agreement, you do not know that the laws of our nation provide that, "if
